Actor TJ. Miller has filed to dismiss a lawsuit stemming from an alleged altercation in a taxi cab in December (16)
The Deadpool star and his wife Kate used the Uber car service app to get a ride home after making appearances at two Hollywood parties in December (16) when Miller allegedly became involved in a heated argument with the driver Wilson Deon Thomas III and struck him on the shoulder and head.
The driver reportedly performed a citizen’s arrest and called the police and Miller, who was preparing to host the Critics’ Choice Awards at the time, was arrested and taken into custody on unknown charges.
Thomas also sued the Silicon Valley actor for assault and battery and intentional infliction of emotional distress, claiming he was forced to slam on the brakes of his vehicle after he was allegedly hit and the incident resulted in injuries and anxiety.
Miller’s lawyer Bryan Freedman filed a reply to Thomas’ complaint at the Superior Court in Los Angeles on Monday (13Mar17) in which he denied all the claims and accused Thomas of attempting to extort his client.
From the moment Mr. Miller and his wife stepped into Mr. Thomas’ vehicle and he recognized Mr. Miller as a comedian and Hollywood actor, Mr. Thomas started a plan to try and extort money from Mr. Miller, even commenting that Mr. Miller was ‘a rich guy’.
Freedman wrote in the legal papers obtained by The Hollywood Reporter.
He also wrote that the cab driver was “no stranger” to making up stories and cited a similar lawsuit he had filed against his employer which had been thrown out.
When Mr. Thomas looked at Mr. Miller and his wife throughout his rear view mirror, he saw nothing but dollar signs and was determined to get his. The best he could find was a doctor who would say nothing more than Mr. Thomas exhibited ‘minor aches’ and ‘slight pain’ from the alleged incident.
Freedman continued.
Freedman calls for the lawsuit, which he describes as “a money grab”, to be completely dismissed and for Miller to be awarded costs and attorney fees.
